Travel Spoken – Terms and Conditions

Welcome to Travel Spoken ("we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, mobile application, digital content, booking services, and any related features (collectively, the "Platform"). By using the Platform, you agree to be bound by these Terms.

Please read them carefully before using our services.

1. Eligibility and User Account

To access certain features of the Platform (such as booking, saving preferences, or joining community discussions), you must create a user account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized use of your account.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account with full features and service use.

Users must be at least 13 years old—or the minimum age of digital consent in their jurisdiction—to create a teen account with limited access to features and services. Travel Spoken complies with the Children's Online Privacy Protection Act (COPPA) and other applicable child data protection laws.

2. Scope of Services

Travel Spoken provides curated travel content, booking tools, guided audio experiences, event registration, cultural insights, and communication features via web and mobile applications.

Services may include:

  • Booking of flights, stays and vehicles.
  • Booking of tours, experiences, or digital events.
  • Access to maps, itineraries, and travel planning tools.
  • User-generated content sharing and community interaction.
  • Educational materials such as podcasts, videos, or blogs.

We do not directly operate transportation or lodging, and such services are provided by third-party partners.

3. Bookings and Payments

All bookings made via the Platform are subject to availability and confirmation. You agree to:

  • Review the full service description before booking.
  • Pay all associated fees, including taxes and service charges, using an accepted payment method.

Payment Processing:

Secure payments are handled by third-party processors (e.g., Stripe, PayPal). We do not store full credit card information.

Cancellation Policy:

  • Cancellations made more than 14 days before the scheduled event receive a full refund (minus processing fees).
  • Cancellations 7–14 days prior receive a 50% refund.
  • Cancellations within 7 days are non-refundable.

Custom terms may apply for private bookings or third-party services and will be disclosed at checkout.

4. User Conduct and Community Guidelines

You agree not to:

  • Use the Platform for unlawful, harmful, or fraudulent activities.
  • Upload or share defamatory, abusive, obscene, or offensive content.
  • Impersonate others or misrepresent your identity.
  • Scrape, crawl, or attempt to reverse-engineer the Platform.
  • Violate any applicable laws or third-party rights.

We reserve the right to suspend or terminate accounts violating these terms.

5. Content Ownership and License

All content provided on the Platform, including text, images, videos, audio guides, and software, is owned by Travel Spoken or licensed from content creators. You are granted a limited, non-exclusive, non-transferable license to access and use this content for personal, non-commercial use.

You may not reproduce, distribute, modify, or exploit the content without written permission.

User Content: If you post reviews, photos, or comments, you grant Travel Spoken a non-exclusive, royalty-free, worldwide license to use, display, and promote your content in connection with the Platform.

6. Privacy and Data Protection

We respect your privacy. By using the Platform, you consent to our data practices as described in our Privacy Policy. This includes how we collect, use, and store:

  • Account information
  • Location data (e.g., for location-based services)
  • Usage and activity data

We implement reasonable security measures, but you acknowledge that no platform is fully immune to security risks.

7. Limitation of Liability

We strive to ensure high-quality services, but to the maximum extent permitted by law:

  • Travel Spoken is not liable for any indirect, incidental, or consequential damages resulting from your use of the Platform.
  • We are not responsible for delays, cancellations, or disputes involving third-party providers (e.g., tour operators, transport).
  • We do not guarantee uninterrupted or error-free operation of the Platform.
  • We accept responsibility only for issues arising directly from our own verified negligence or breach of duty, not from circumstances beyond our control.

8. Platform Availability and Modifications

We may:

  • Update or modify the Platform at any time without prior notice.
  • Interrupt service for maintenance or technical reasons.
  • Discontinue features or restrict access at our sole discretion.

9. Third-Party Links and Integrations

The Platform may contain links to external websites, services, or third-party bookings. Travel Spoken is not responsible for:

  • The accuracy, safety, or content of third-party sites.
  • Issues arising from transactions or use of services hosted by third parties.

Use such links at your own risk.

10. Intellectual Property

The name "Travel Spoken", our logo, brand elements, and all associated content are protected under intellectual property laws. Unauthorized use may result in legal action.

11. Termination

We may suspend or terminate your access to the Platform if you breach these Terms. Upon termination:

  • Your right to access the Platform will cease immediately.
  • Outstanding obligations (e.g., payments, licenses) shall survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States.

In the event of a dispute between you and Travel Spoken, both parties agree to first attempt to resolve the issue through good-faith informal discussions. If the dispute cannot be resolved informally within 30 days, it will be submitted to binding arbitration, conducted in New York, New York, in accordance with the applicable arbitration rules. The decision of the arbitrator will be final and enforceable in any court of competent jurisdiction.
